Acceptance
These terms govern your use of eSafety First Canada’s website and of the online safety training courses and related services we provide, including through any affiliate or subsidiary. Please read them in full before using the website or buying a course.
Disclaimer of liability
eSafety First Canada is not liable for any loss, damage (direct, indirect or consequential), personal injury or expense of any kind suffered by you or by any third party (including your company) arising from your access to or use of the website, from any information it contains, or from the transmission of your or your company’s information over our systems — except where the law does not allow that liability to be excluded. The same applies to delays, inaccuracies, errors or omissions in information on the website, to anything done in reliance on that information, and to any interruption or termination of the service.
Use of our Website
By using our website and any affiliated or connected website, you confirm to eSafety First Canada that you are legally entitled to do so and to use the information it makes available.
You keep access to a course’s training material for the validity period of that course’s certification. That period varies by program — most run three years, others one or two — and for WHMIS it also varies by province: one year in Ontario, three years everywhere else. The exact period for your program is stated on its course page.
Ownership
All course presentations and materials are owned by eSafety First Canada.
Buying a course gives you the right to take the training. It does not give you any ownership of the course content, nor of anything associated with your account or stored on the service.Terms of Payment
Payment in full is required before you receive access to any online course material. All refund and credit requests are handled under our refund policy, without exception.
Trademarks
The trademarks, names, logos and service marks (“trademarks”) shown on this website belong to eSafety First Canada, whether registered or unregistered. Nothing on this website grants you any licence or right to use a trademark without eSafety First Canada’s prior written permission.
Warranties
eSafety First Canada stands behind the accuracy of its training: our courses are built to the standards named on each course page — including the applicable occupational health and safety legislation and CSA standards — and we keep them current as those standards change. Beyond that promise, eSafety First Canada makes no other warranty about the website or its contents. Completing a course does not by itself make a workplace compliant: applying the training, meeting employer duties and complying with the law in your workplace remain your and your employer’s responsibility.
Account Suspension/Deletion
eSafety First Canada may suspend, modify, terminate or delete an account at any time for abuse of our system — including a breach of these Terms and Conditions, or working for or with directly competing companies or their affiliate programs.
Accounts closed for abuse are not reactivated, and no refund is given on them. The goodwill cases in our refund policy do not apply to accounts closed for abuse.
Conflict of terms
If these terms conflict with other terms, policies or notices that relate specifically to a particular section or module of the website, the specific terms prevail for your use of that section or module.
Severability
If any provision of these or any related terms, policies or notices is or becomes unenforceable in a jurisdiction — for any reason — it is treated as void there, and only to the extent it is unenforceable. All remaining provisions stay in full force.
We reserve the right to select our customers
Our support services — email support, feedback and review collection, and toll-free phone support for existing customers — are free for our customers. We reserve the right to refuse service to customers who are abusive towards our staff, or who use our channels for political messaging, hate speech or other offensive or derogatory remarks.
Account Inactivity
If your account holds group leader access and your training group still has unused credits, and you have not logged in for 10 consecutive months, eSafety First Canada will flag your account as inactive and notify you by email.
If you do not log in within 2 months of that notice (12 months of inactivity in total), your account and any remaining unused credits will be permanently deleted. This does not apply if a sub-account linked to your group has logged in within the same 10-month period.
Applicable law and where disputes are heard
Your use of this website and of any affiliated website is governed by the laws of Romania, regardless of the laws that might otherwise apply under conflict-of-law principles. Any dispute arising under this agreement is heard exclusively by the competent courts of Romania, and both parties agree that venue is proper in those courts.
